Failure to deliver titile

I recently bought a 1985 Toyota 4 Runner from the user (RockRash). I drove about an hour to get it and spent about 4 hours to get it running. I paid the full amount asked for the 4runner; I didn't haggle with him or anything. RoCK rASH told me that the runner was in fine mechanical shape except for it needing a timming chain. We filled out a bill of sale and he told me that he would have me the title the following week. I got the runner home and cleaned the inside out and changed the carpet. I was waiting on the title so that I could get a tag and insurance for it. In the mean time, I had one of my friends who is a certified mechanic to come and give me a price on the timming chain install. He stared the runner and tinkered with it for a few minutes to get it idleing just right. After a few minutes he told me that it wouldn't be worth putting a timming chain on. He said that the engine noise was a broken wrist pin. I was super pissed but I figured that I would get over it. Then I did more cleaning on the runner and changed out the nasty seats with some better ones. Throughout the next few weeks I tried calling RockRash a few times about the titile, always leaving polite messeges. It has been almost 5 weeks and I have no title. RockRash won't return my phone calls at all. I even bought a new 22re for the runner....I'm extreme'y P oed right now....RockRash...If you are reading this....I'm going to the DMV to report you for FAILURE TO DELIVER TITLE. I would have given you 3 months to get it for me if you would have kept in contact with me......SORRY THAT I HAD TO DO THIS BUT YOU FORCED ME TO IT.

uh, he diagnosed this how? just by fiddling with the idle and listening to it? not saying he's wrong, but in my experience a worn chain slapping the guides in a toy sounds alot like what many call piston/wrist pin slap. even if he is right, he's either a great guesser or has an ear from another world if that's all the diagnostics he did.

getting a title is a bit of a pita, but not impossible assuming there are no outstanding liens against the vehicle.

i feel for your situation assuming it's factual, but like SO many of these threads this could all have been avoided by using a little patience/common sense in demanding a clear title before purchase. it's a damn shame you can't take most people at their word anymore, but that's the way it is.
 
he came to the broken wrist pin conclusion because of the way it smoked when he reved it up and the noises it made......he ratteled off a bunch of reasons to me but I didn't really understand what he was talking about ( I'm suck with engines)

I would be very surprized to see a broken wrist pin. These engines are somewhat noisy new. It could be as simple as valve adjustment.
 
Jeff, i kinda agreed with what Larry said. From the very beginning, i thought it would be kinda hard to diagnose a wrist pin without some kind of disassembly. If the engine does in fact have timing chain isssues, that noise of the chain slapping the front cover can make a lot of noise. I just can't see how he says its a wrist pin by just listening to the motor, just doesnt add up.
 
Just drop a tree-fiddy in that biotch and be done with it! :)

To me, the wrist pin is irrelevant. The failure to deliver title is the important part.
 
The title needs to be resolved. No doubt, I'm waiting on one myself but, its a part truck so no biggie.


The wrist pin is probaly not a issue. A busted piston, maybe, chain slap, eaten timing cover, piston slap, broken skirt, yeah, definate potential there. Just pop it down and have a look, that thing is about as complex as a briggs and stratton. Engine kits are cheap and Compwizz knows all the flow tricks for the head. :flipoff2:

In 20+ years of beating on 22r's and re's I've never seen a wrist pin break, thise are about the strongest parts in the motor. Seen many a bent rod and busted piston or rings from spark knock or hydro locking though.

It is not against the law to not give the new owner a title. It is the buyers responsibility to secure the title from the seller when he purchases the vehicle. Also, make sure the VIN numbers match the vehicle.

I was sued some years ago for not giving somebody the title. He had not payed me entirely for the car and was driving it around with fictitious plates. After getting busted 1.5yrs later he became concerned about the tittle so he could register it and have his charges reduced. I told him to blow me, I did not care about the money anymore and he could sue me.

The judge ruled in my favor and stated the aforementioned laws to me. You may be screwed if you did not get the title. Unless you can prove you had an agreement to retreive the title at a later date. Got a contract or something similiar?

I'm also skeptical of the wrist-pin diagnosis. As stated it's by FAR the least likely failure in these motors.

To be clear,m I don't think any of us is calling yer buddy mechanic a liar, ass-talker or anything. We'd just liek to know how one could come ot such a diagnosis.
Tel lyou what, could you do us a favor - it sounds like may know a trick I (at least) do not. Have him post up a thread here on how to tell a wristpin is boken w/o removing anything.

Me, I'm calling bullshit on the wrist pin. Aint no freaking way a 22re makes enough of anything to break a hardened steel wrist pin. The rod would turn to power way before that pin would give and the piston would be gas. :beer: Granted it might be eating its way out of the block. :lol: Where is this runner anyway? If its near where I'm going to be this weekend, I'd love to hear this mill run.
 
CJ4PLAY and myself went and looked at the same 4Runner a week or two before you bought it...but he never got it running while we were there...

he "seemed" to be a decent guy, but I'd never met him before...

if he ever tells you he's got it at work, but keeps forgetting to mail it...let me know...it's about a 20 minute ride to his office, and I'll go pick it up and mail it to you...;)

He won't tell me anything....won't return my phone calls.....I call him a few times a day....If he can't get the title then he needs to tell me....I wouldn't be as pisssed if he would just let me know something
 
I have alway found to be good is if you have a lawyer friend, have him write a letter.. its amazing how quick people respond to them, if not, a simple certified letter from you would typically get his attention, if not alteast you have proof now you contacted him. i think its $1.12 at the post office
 
I went to the DMV today and the inspector is going to get ahold of the Gaston county inspector. If I don't get my title or the money...he will have to pay a 300ish dollar fine...will have a crimminal record and then I can take him to civil court
 
where is the guy from? maybe in the military? if he is reserve even, there is a chance that he may be out doing some sort of training. Not saying thats the deal, but could happen. NC has a lot of military in it. There are over 20,000 active army guys here just in bragg, not to mention all the reserve and national guard guys running around.

As Bigwaylon said, Rockrash seemed to be an "OK" guy to us.

Jeff, since he was on yesterday, maybe he'll try to contact you privately? Just trying to be optimistic.

hopefully...I just want my title so I can go ahead and put my dual trannies and new 22re in it
