I would crib it up and cut the posts out from under it a little at a time with multiple jacks lowering it slowly down to the ground and eventually on the trailer.

That's how I did my girls' playhouse. Jacked it up and supported it with cribbing, backed the trailer under it, and slowly lowered it on the trailer. Built it in Roxboro, loaded on trailer, and transported it to Greenville. Unloaded it the same way. Only difference is height of the tree house. Cribbing can take care of that pretty easy. :)

I would risk it though and not worry about being legal in towing it if I was moving it locally.

Ran into this once, got a play structure from a friend, "You can have it if you can remove it". How up and discovered they fenced the yard after building it. Had to dismantle it into pieces I could carry out.
 
5v tin is listed as 1.4 lb/ft. That's 200-300 lb range.
Cedar is 2.4 lb / bf. That can add up quick! Shingles appear about an inch thick so each shingle is a couple pounds.

Yeah I could see it pushing 7k at least, that's some big thick cedar and as mentioned the shingles will really add up.

The contractor figured it out for the crane company when we were considering moving it.
The wood was fresh cedar and hand cut so it's thick and carried the sap in it so heavier

It can't weigh that much. My girls' playhouse was only about 4200lbs with full T&G siding and 1/2" Sheetrock inside, 8'x16'

No way this playhouse weighs over 5000lbs

It's built like a brick shithouse, tearing it apart/taking it down will be a bitch. It's a shame they could not get a variance from the hoa, it looks like it would be out of sight from the neighbors in summer. If it was mine I'd ask for a vote from all the homeowners before I removed it, if a majority were ok w it the hoa should be too.
 
I think HOA's is one of the few things that begging for forgiveness is not usually better than asking for initial permission. If it's clearly stated in the HOA, they would have to vote to eliminate the rule all together. You can't just let one get by with it or you'll be setting yourself up for the next person to build a much bigger and ugly one. He points the finger towards this one. Next you got an implosion in the HOA.

People pay big fees for an HOA sometimes ranging from $200-$400 a month depending on how much and how big the amenities are. If I paid that much, I damn sure wouldn't want the HOA to pick and choose who can get by the rules and who can't. No judge would go along with this.
 
Remember, HOA covenants are filed with the Register of Deeds. So, you have zero chance fighting them in court. They are public record and easily obtained. There is no excuse for ignorance when violating the covenants.

Our HOA just filed lien paperwork for violations. Homeowner had every excuse imaginable but it was a clear cut violation that was 2+ years running. Lien filed with no issue. I imagine the tree house homeowner is trying to avoid this same scenario. Many underwriters have major issues with liens being filed on real property they are financing ;)

This is almost 100% inaccurate.
Your primary mortgage holder has irrevocable 1st position.

Meaning no matter what they get made 100% whole before a penny flows down to subsequent lien holders.

In order to foreclose from a submissive position you have to buy out the dominant position in whole first. IOW your lien is useless UNTIL the owner voluntarily sells the house.

I've got a rental right now in this situation. The enacted a change in covenance after I purchased and decided to disallow rental property in the neigborhood. The president smugly informed me I had 180 days to comply or he would "take my house"....Wells Fargo gladly issued a 30 year fixed for 60 LTV. I smiled and told him I never planned to sell and would just cash out refinance it until.....

We are about to de-rail the thread permanently.
If we are talking about SFHs and not condo, townhouses, row houses, etc this will actually be only the 2nd time Ive ever heard of it.
Plus an owner leasing it out is not subletting or subleasing. A renter then in turn leasing it out/renting it out is subletting.

If I get a lien on my property, I'm in default; its in the paperwork. Tell me again underwriters having issues with leins inaccurate?
