HELP? around Durham, I've been stuck for 3 days

I do not see where that is illegal if there are no signs posted then the cops really can't just roll up and give you a ticket.
.

it's the "powerline" part thats got everyone worried. there doesnt need to be signs to be busted for trespassing on a utilities right of way. he says there is a big pipe directly in front of him, which means he is smack in the middle of that right of way.

yes, the chances of the cops actually busting anyone is slim and in all likely hood if he is patient enough, someone will get him out and the cops will never know.

help

Dam, the guy screwed up. I hate for people to come to NC4x4 and talk or type to the same ole 20-25 people. Everybody else has been ran off or to scared to say anything. Its like bickering old people or children. If someone new comes its like lets see how fast we get rid of him.

Agree with ya here. Lots of people that respond to help request, technical or other, with nothing that resembles help.

Wish I was closer. I'd figure out a way to help you just like I had been helped over the years. Learned many lessons.

honestly i just don't understand why people get so mad. get him outta there then give him crap. dont make it such a big deal how about if you've wheeled illegally dont post up hateful stuff about it. we used to ride powerlines by our house on 4 wheelers. we actually help the people who owned the land out by knoking all the overgrown grass down on the land that he bushhoged. the only thing we got crap about was the when our neighbors would get pissed because others would track mud up and down our road and we got the blame or they would fly up and down the road and we got blamed for it for chasing them down on our racing fourwheeler to get them to stop. and when others found our spots and then made there own in the corn

If the lines are surrounded by someone's private land, the landowner (and therefore you) may have the right to drive across the lines to their other property. However, legal or not, my junk ain't heavy enough to pull a K5 up and out of that situation. You'd almost need a Deuce.

FWIW, if you can get written permission for someone to wheel on that land to recover you, they're not going to get a ticket and should be able to step up more easily. AND if this is illegal, we tend to ban illegal wheelers. However, we only do that after the recovery. So there's no need to be screwing around and talking shit in this thread. Either step up and help or stfu the point's been made, the damage is done. Let's figure a way to fix it.

we have a big TJ with a winch here at the shop today...give me some details and ill go see what I can do..........

Agreed...you have to have REAL tough skin to not be run off from here

This is the softest, nicest forum I peruse. Not saying there is anything wrong with that, but I wish there was more shit talk going on around here! I try to refrain though, that isn't the type of thing this board is geared to, and i recognize that, but to say thick skin is required is quite an overstatement.

honestly i just don't understand why people get so mad.

Because it is people like this that give US a bad name. How hard is that to understand? Bad enough that he is out there in the first place, then comes broadcasting it on a public forum? You won't get sympathy from me, or anyone else who recognizes how detrimental this is to the one thing that presumably binds us all together on this forum.

my second post...the one everyone is mad about...explains rather abrasively why people get so upset.

in more friendlier terms....

we can't really afford not to jump all over some one for wheeling illegally. Our big two OHVs are under fire this year, tellico has already been shut down.

The people who want it shut down have the ability to (and probably do) monitor this website.

The original poster chose to post his story about getting stuck on illegal land (and yes, he claims to have "permission" but its sketchy at best at this point). If the people who are anti4wd can see this conversation and no one stood up and said anything then they could say we condone this sort of thing.

It is real important that at a time when we face losing our public OHV access that we not fuel any of our opposition. By showing them that we do not condone illegal wheeling and really do try to abide by the law and we're not just out in the woods tearing things up with wanton disrespect for the law we may be unwittingly helping ourselves.

There is a place on this website that he may have had a better reception. somewhere a little less public if you get my drift.

 no disrespect to the OP or anyone else wondering why this topic upsets people so much. its just real important to us.

this place has always been the softest forum....but there was a time a year or two ago where it was pretty rough for newbs.

I guess it comes in cycles, as the wet season comes around and the newbs hit the mud in the illegal places. then they come around here for help or to show the muddin pics the flaming starts up.

But if he is on a power line trail then it is illegal and can cost you 1500 for pulling him out if you get stopped the trail has to go to a road somewhere and that is when you get the ticket
If you get on the road and a cop shows up He will most likely ask what are we doing . so it wouldn't be a instant 1500 fine .

didnt someone say this place was blocked off by rocks at the gate?

§ 14‑159.12. First degree trespass.

(a) Offense. – A person commits the offense of first degree trespass if, without authorization, he enters or remains:

(1) On premises of another so enclosed or secured as to demonstrate clearly an intent to keep out intruders

§ 14‑159.3. Trespass to land on motorized all terrain vehicle.

(a) No person shall operate any motorized all terrain vehicle:

(1) On any private property not owned by the operator, without the consent of the owner; or

(2) Within the banks of any stream or waterway, but excluding a sound or the Atlantic Ocean, the adjacent lands of which are not owned by the operator, without the consent of the owner or outside the restrictions imposed by the owner.

(b) A "motorized all terrain vehicle", as used in this section, is a two or more wheeled vehicle designed for recreational off‑road use.

(c) A violation of this section shall be a Class 2 misdemeanor. (1997‑456, s. 56.8; 1997‑487, s. 1.)

And no one has said where there are signs or not...but....

§ 14‑134.2. Operating motor vehicle upon utility easements after being forbidden to do so.

If any person, without permission, shall ride, drive or operate a minibike, motorbike, motorcycle, jeep, dune buggy, automobile, truck or any other motor vehicle, other than a motorized all terrain vehicle as defined in G.S. 14‑159.3, upon a utility easement upon which the owner or holder of the easement or agent of the owner or holder of the easement has posted on the easement a "no trespassing" sign or has otherwise given oral or written notice to the person not to so ride, drive or operate such a vehicle upon the said easement, he shall be guilty of a Class 3 misdemeanor
______________________________________________________________________

if you come across an officer in a bad mood that could quite possibly be up to 3 counts of trespassing and a hell of a lot of fines. Worst case scenario....6 monhts in jail.

again, legally this is contingent on a sign.....but can still be charged, up to defendant to explain in court if the cop is in a bad mood.

but it could be count four.

and im not flaming anyone. Im just making the public aware of the laws, there seems to be a few people with questions. these last few posts are not directed at anyone in particular....just some info for the general public

14‑159.3, upon a utility easement upon which the owner or holder of the easement or agent of the owner or holder of the easement has posted on the easement a "no trespassing" sign or has otherwise given oral or written notice to the person not to so ride, drive or operate such a vehicle upon the said easement, he shall be guilty of a Class 3 misdemeanor, provided, however, neither the owner of the property nor the holder of the easement or their agents, employees, guests, invitees or permittees shall be guilty of a violation under this section. (1975, c. 636, s. 1; 1993, c. 539, s. 75; 1994, Ex. Sess., c. 24, s. 14(c); 1997‑487, s. 2.)

You have to read very closely into all of these laws .
If you also look into it a inspector can fail any lifted or lowered vehicle by law

So in all reality we are all braking the law by altering the vehicle suspension
And yes you could get a fine for it .

No, you're allowed X amount of lift.
Also more if it's "modified for off highway use"

I have seen a thread where you were asking for help for a lawyer a few weeks back. I dont think you were chastised. As matter of fact, I tried to help you as well.

i just realized you directed that at me. i think we did use the lawyer you recommended, thanks  he has been very helpful.

lol, and it wasnt for me...it was for my fiance.

Not wise at all. NC laws have changed. In the state now .16 is very bad. Beleive me when I say how much this could cost you. Between 3k-5k. You dont want to know the penalties if she gets convicted.
I speak from experience because i had a problem two years ago. Laws changed December 06. Very bad right now. Hopefully she has a clean record because that is the only thing going for her. Check your PM box.

and thats a little chastizing...no sweat off my balls. what do you expect! the OP in this thread hasnt heard anything rougher than what you said here.

Is this guy still stuck? Can someone give me an idea of how sloppy it is getting to him. I have been wanting to make a trip to raleigh to go to BJ's (like SAM's Club) and this could be my excuse/gas there. The down side is I am a stock 3/4 ton burb with mild A/T tires and cannot afford to get myself stuck. If noone else is going to help the guy I may have to make the 90 minute trip. P.M. your phone number and we can discuss it. I will want to see some pics before coming all that way to make sure I can stay on solid ground. I do not have a winch though. Let me know and I can see what I can do.

he said he had 5ton winch on a stock dodge but was worried the dodge wouldnt make it down the trail. i asked him for pics earlier to help clarify is situation.

I actually got asked a couple of weeks ago about my NC4x4 sticker in garner. The guy asked was I a member and i said "Oh Yeah, its a great place". The guy says that it is full of A-Holes. Well i stuck up for it then and in the past. Its getting harder to do when these guys bring up screennames and threads.
How many people on here that talk trash to other people actually have NC4x4 stickers trying to grow the membership. I do on my Jeep, truck, and the wife's Nitro.

Well said

I new who needed the help and also I was very polite and respectful on everything I said in that thread, this thread and others.
Im glad you could use the help. The last quote was being rough. i dont see how considering i was giving the situation now on DWIs and speaking from experience.
Not exactly sure what you meant anyway. As for what I said in this thread, it was the simple truth.

WTF?
Did someone help the guy out or what?
He said he had two people with winches going out after work today to try and get him out.
So I'm guessing he got out and is happily buying them a pint of their favorite beverage for helping him.
