ticket for being lifted

I got pulled over on 321 from dallas the cop wrote me a ticket for being lifted 6 inch above manufacturer specifications.. what a douche back.how can I get out of this
 
Your ticket should have a legal statute you supposedly violated, google that number, see if there are exceptions for off-road applications.
 
Hire a lawyer. You don't attempt surgery yourself, so why attempt legal representation. Let the lawyer do his job, my bet is, he's better versed in the law. And might be able to pull a few more strings than you can.
 
What were you doing to draw his attention? Dallas is pretty redneck, and there are a lot of lifted trucks and jeeps that go through there on a regular basis, mine included. I've probably driven through Dallas a thousand times, and never had a single problem.
 
Curious...did he have a book with the stock height listed for your vehicle? How did he know?

And...why did he pick on you...or was the lift the primary violation?? Did you get any other tickets? Do something to get his attention? Does your rig belong on that "scary steering" site?

Just wondering...
 
sounds like a non-moving violation which = no points. pay the fine and move on if its not outrageous or if you have the time to spend fighting it
 
none of that. If anything he pulled me over for going slow. I wasn't speeding it was at night she he couldn't tell anything hardly. It drives like a cadalic until it finds grooves. Its an 03 liberty on 36
 
Why try to get out of it? If you have a 6" lift and the law says no lift then just pay the fine.

My bet isthe law says you can have some lift and your truck might have too much. If you only have 6" and he wrote you for 6" then you find 2" is ok then he should have wrote you for 4" which means you can get out of it because he wrote it wrong.
 
Also he had no book thati seen he deff did not measure my jeep he juss looked at it. Also I'm pretty sure they made a trail ready edition from the factory.
 
There used to be a sticky thread on here about NC lift laws.

If you didn't confess how much lift you have and they didn't measure it should be an easy out. Just prove the 6" was wrong if that's what's written on the ticket.

Lift laws are all over the rececnt rags. JP, Peterson's, and even saw a Hot Rod mag with high performance laws on the cover. Welcome to Obamaville.....
 
Sounds like to me he was bored and picked on. was he a young cop if so he was probably trying to prove himself and is having a power trip. See that alot in Elkin.
 
I would fight it just to make him come to court over it... I'd also represent myself, talk to the assistant DA or whomever.... and if it didn't go my way, on the court date i'd ask for an extension and then hire a lawyer...

I'm guessing it'll get dropped...

NC Has no law against lifting 4x4 VEHICLES...
His vehicle has special components designed for occasional offroad use (I.E. a transfer case)

I thought I saw that recently in a mag and it said no more than 6". has anyone asked you if the lift is over 6"?

A quick search found this statute posted 27 times on this forum....

§ 20‑135.4. Certain automobile safety standards.
(a) Definitions. – For the purposes of this section, the term "private passenger automobile" shall mean a four‑wheeled motor vehicle designed principally for carrying passengers, for use on public roads and highways, except a multipurpose passenger vehicle which is constructed either on a truck chassis or with special features for occasional off‑road operation.
(b), (c) Repealed by Session Laws 1975, c. 856.
(d) The manufacturer's specified height of any passenger motor vehicle shall not be elevated or lowered, either in front or back, more than six inches by modification, alteration, or change of the physical structure of said vehicle without prior written approval of the Commissioner of Motor Vehicles.
On or after January 1, 1975, no self‑propelled passenger vehicle that has been so altered, modified or changed shall be operated upon any highway or public vehicular area without the prior written approval of the Commissioner. (1971, c. 485; 1973, cc. 58, 1082; 1975, c. 856.)

I.E.
If you have a frame or "special features for occasional off‑road operation" you are not subject to that law. You have a transfer case, right?

I would not only fight the ticket but also ask for remuneration for taking time off work to fight this trumped up charge. Clearly the officer did not do his job nor know the statute for what he cited you.
 
A quick tip for everyone.
If you do anything in life make sure you are educated about your actions.
For God's sake we are the local home for modified 4wd vehicles and we have long time members spewing bad info.

I give the OP a pass he came asking for advice/expertise.
If a cop pulls you over and says you were speeding and the punishment is forced sodomy, are you kneeling down? Well someone said so....

Learn the law, learn your rights, follow them, be polite and you will never have legal troubles
 
He quoted the exact statute right there and gave you an example of legit recourse...
I think nc purposefully left it vague so as not to have to deal with measuring 4x4 truck heights.

I was saying if the law says you can't lift it. Since you can lift it in NC then definately fight it.

he should have written permission to drive it.
 
Quick question, does it in fact specifically say it's for being 6" taller and that reason only? I remember back in high school I had a couple buddies with lifted vehicles and the ticket had something to do with exposed and unprotected undercarriage components (ie the gas tank) due to the lift height.
