ticket for being lifted

SC has the same law. I recieved the same ticket. I also recieved a ticket for the headlights being too high. I paid the fine for headlight too high but fought the raising of a vehicle more than 6". I lost and had to pay the fine anyway. Mine was in a k5 blazer on 42s.

The funny thing is, a few weeks later, the same cop gave me a ticket in my other truck for the headlights being to low. I won that one in court. The law was wrote in the 50s before they had all these low riding sports cars.

Just pay the fine.
 
The problem is if I pay it. He will just write me another one... and for the k5. Think about it. If u car is lifted 6 inches to high of coarse ur headlights are gonna be too high...I prolly got behind the cop late one night and he didn't like the fact my headlight was shinning in his car... but shit how does he know it is lifted too high. Does this include the height of the lift and tires combined???? If the law does apply to me it says you can get a permit for it...
 
I'm only gonna try to explain this because I see your liberty pretty often and I like it. Since you have a transfer case you can be lifted up to 6 inches without the commissioners approval. Therefore if its lifted less than 6 inches it does not apply to you. I'd assume its 6 suspension inches.
 
If I was the grammar police I'd give you a ticket for too much in one sentence without any punctuation, but that's just me.

You can lift a truck more than 6" and still be under the headlight law. I think the headlight law states that your driving lights can not be higher than 54". Mine were almost 60.

That doesn't matter though. I was just telling what happened when I recieved the same ticket. And yes you probably did something to provoke him. You drive a vehicle that draws attention to you, what do you expect. You like the attention so deal with what comes with it.

Your liberty is going to be registered as either a SUV or a WGN(wagon), neither of which is a truck. If it is raised more than 6" you broke the law.

but this is equipt with special equitment for occasional offroading. as the statue says.... i agree with everyone else. the cop doesn't know the law. Was in the wrong for giving me a ticket.

As far as the law, your good the cop is wrong, fight it yourself. Take a printout of that statute from the link of NC website posted earlier. And if you can something that shows your vehicle is factory 4wd. (title,registration, maybe a build sheet from Chrysler with the VIN number on it). That May be important as your liberty is not on a truck frame but is equipped with a part time T-case and front drive assembly. (leaf off the extent of modifications when talking to him and tell him the cop just guessed at the height). IF you cant get all this together before hand go and file for an ext. you could probably just quote the statute and tell him its a 4wd liberty and the DA will let you off. There actually kinda reasonable, at least in union county they are. Unless you've just done something really dumb. I've had them laugh at some of the stuff I've been ticketed for.

That being said, I'm no lawyer but i really think you should have no trouble getting this dropped yourself. Chances are the cop wont even be there too back up his story. (I've never had one show, as they don't need to there cops. There word is always right:lol:)
 
black with no flares...infamous4x4 sticker on the steering rods, dented up right side then its me... Actually its the only one around that i know of lifted more than 3 inches

I have had plenty of tickets and used plenty of lawyers... Here is my suggestion as mentioned above. Print off the statute and take your registration to the da's office long before your courtdate. Talk to them and explain you did nothing wrong. Be very nice and polite yes maam kinda thing. If they will not drop it call David Phillips he is by far the best in Gaston county.
 
seems to me your saying it can be lifted however much with no limit at all? These things are all in how you interpret them I guess.

Guess I am saying they left it vauge enough that you shouldn't have any problems in most cases with lifts even over 6".

After going back and rereading it I agree with you. Since this vehicle is meant for offroad use and has a tcase from factory the amount of lift shouldnt matter. That being said it should be no problem getting this dropped without a lawyer.
 
Interesting... I have 10" of lift and haven't had a problem... yet. I did get pulled by the NCHP in Boone year before last for speeding and nothing was said about the lift at all. He even let me off with a seatbelt violation instead of the 53 in a 35 because my driving record was clean...... That cost me a flat $100 and no points at the time. He said he wanted me to slow down so the $100 would get my attention but not hurt me with points. Funny part is the truck is so tall his head came up to the bottom of my window.

Well atleast we will all know that law if another rookie cop trys to prove his self. I really hope he feels like a idiot and catches shit about this. Because he wasted my time and having people ask em what I did this time... thanks again everyone
