He does, that is what inspections are for. They serve as the approval of the Commissioner.

got a statute on that? not being a smartass just wondering. It seems odd that you have to have written approval on just those vehicles. Why not say these vehicles are subject to the same standards as personal passenger vehicles and are required to have an annual inspection? Written approval typically means something written, ie- a letter.

§ 20‑135.4. Certain automobile safety standards.
(a) Definitions. – For the purposes of this section, the term "private passenger automobile" shall mean a four‑wheeled motor vehicle designed principally for carrying passengers, for use on public roads and highways, except a multipurpose passenger vehicle which is constructed either on a truck chassis or with special features for occasional off‑road operation.
(b), (c) Repealed by Session Laws 1975, c. 856.
(d) The manufacturer's specified height of any passenger motor vehicle shall not be elevated or lowered, either in front or back, more than six inches by modification, alteration, or change of the physical structure of said vehicle without prior written approval of the Commissioner of Motor Vehicles.
On or after January 1, 1975, no self‑propelled passenger vehicle that has been so altered, modified or changed shall be operated upon any highway or public vehicular area without the prior written approval of the Commissioner. (1971, c. 485; 1973, cc. 58, 1082; 1975, c. 856.)

I would not only fight the ticket but also ask for remuneration for taking time off work to fight this trumped up charge. Clearly the officer did not do his job nor know the statute for what he cited you.

ya can't fix stupid. My advice to the OP is to either get a lawyer or pay the fine.

This is why I asked what statute was quoted on the ticket, and what you were cited for.

From what i read on skyhi's post the law exludes your vehicle because it has been designed as an off road or dual purpose vehicle.

For me there are three things you never mess with or especially never bargain shop for: Doctors, Lawyers, CPAs... let the professionals do what they do for you.
 
there was an article in petersons off road adventure about this stuff it kind of out lines lift laws in the southern states..

To the OP, this was definetly your unlucky day. Like Matt said, there's alot more lifted vehicles running around here than your average equal size town.

What officer wrote the ticket? If you're going to go the lawyer route, David Phillips can make this dissapear;)

You fail at reading comprehension.
Since his vehicle is either constructed on a truck frame (honeslty I dont know if Libergays have a frame or not, and dont care enough to search) and has a TC, it is not subject to that ENTIRE SECTION...

the first part of the law says you shall not modify cars and makes it illegal to modify them, the part you quoted maks it illegal to operate them on oads or other public areas. Trucks are still excluded.
 
how much is the fine? Is the cost of fighting it and being off work really worth the cost of the fine?

Sometimes its a principle thing, I get that, but I'd at least consider the financial side of it.

By the law, it APPEARS that the case should be dropped. You going to get any recourse for missing work? highly doubtful.

While I agree with fighting it on principle, ya gotta weigh your options. If its just a fine and less than $200, I'd prob. just pay it and move on, not worth the time and expense fighting it even though it should be dropped...
 
and 5 dollars of the court cost go to the State LEO retirement fund. lol, pay the fine and say your welcome to the next officer you see.
 
Its not about the money its about. Does this ticket apply to me. How does he truley know how high I'm jacked up without a tape measure.. same as the cop thought u was speeding but did not clock you. Can he still write you a ticket? If so for how fast?? Whatever he thiinks.. the main thing is I drive this thing everyday and other people who drive there vehicles everday. I'm not juss gonna pay the ticket if it doesn't apply to me. He told me I needed a permit to drive the vehicle. I've called the dmv in gastonia and raleigh and nobody knows what he was talking about. So how do I get the written paper if nobdy knows about it.?

The only N.C. lift laws I've ever read in a State released article is " no more than four in. of suspension lift and no more than three in. of body lift. But it stated that no more than a 44 in. tire. The kicker is the truck frame, it's a must I'm guessin because I have a friend that got a ticket for to much body lift and the officer that pulled him told him that after he measured it, Then told him other than that he was legal. AS far as it bein a safety issue, I don't think so.If that were the case rail buggys would deffinately be illegal. He paid the small fine ( years ago ) and never looked back, and Marion is a hole in the wall. Good luck...
 
We will find out sooner or later because I've got acop goin to talk to the da. Which he has been a officer for 20 some years and has never heard of anyone writing that ticket.

Your right but nobody is certain of there answer.. also the big question is how does he know it is truley lifted over 6 inch. The tires on it make most the height with 36s
 
A cop talking to the DA for ya....so you have an LEO as your legal representation...if he comes back and says pay the ticket, you gonna pay it?

Actually I just re read the statute....you were pulled in the fall of the year and thee grass was still green. It does apply, but only to you...
 
2003liberty, how old are you? That could determine if the cop was messing with you or not.

You need to go back and read the statute again. It's pretty clear. It was written to outlaw hot rods and donks, nothing more.
 
It shouldn't but if you are a 16 year old cops tend to give less leniency and DAs and judges tend to do the same
 
I'm going to go ahead and call attention whore shenanigans. Scan or take a picture of the ticket and post it up, otherwise... bs.
