Well, your gun wasn't concealed, so I believe you'd be good there. Plus, you told him that you have a permit, just like you're supposed to.

The only thing I know about headlight laws if you have to use them if it's raining enough to need windsheild wipers (incliment weather, etc) and, of course, at night.
 
Judging by the plentiful amount of daylight in the posted picture, you should have been fine without headlights.

I have been pulled over by NCHP on 421 with a loaded weapon in plain site (pass seat) before CCW was allowed and alerted the officer as such. He was cool with it and didnt ask to see it or have me unload it.
 
Ive been pulled with a loaded/chambered pistol on the dash and the officer didnt have a problem with it. I also told him about it as soon as he came up with my interior lights on. I hope everything gets resolved.
 
If I was you I would also contact the mount airy news and possibly WXII new 12. That usually gets things done faster around here. The media loves stuff like this.
 
I live about 20 min from dobson where surry co sheriff station is and those guys are assholes and always have been. They think there the shit but there little better than mall cops. The cops in this area have been pissed ever since that cop in elkin got capped in the head nine times on 77 south about 10 or 11 years ago. The way I see it sew the shit out of them and demand to see the videos. Come to think of it I was in mount airy and remember seeing a truck being searched and told my friend that those f$%kin cops were harrasing people again!
 
Working lots of late weekend nights, I've had dealings with the local law enforcement officers on a few occasions. I've been less than impressed more than once.
While I do not envy them for the tasks they accept by taking that job, I can only say that some of them are poor examples of law officers. Wilkes County had the officers randomly shaking down hispanics and robbing them...Forsyth had a sheriff whose son (also in law enforcement) actually shot himself, then tried to make it look like he was attacked, only for the truth to come out sometime later...and personally, one late Saturday night, as I went to my girlfriend's after work, a Yadkin County deputy pulled me for a license tag bulb being out (please note that he almost wrecked his cruiser turning around as I passed him by), made me stand in the cold with no coat while he searched both front seats for drugs, THEN he searched my jacket, finally decided to hand it to me, and proceeded to search the rest of the car, including the two open containers in the floor (one held crayons and coloring books for my kids, the other had toys...obviously, they must have resembled illegal contraband). I even offered him the opportunity to release his drug dog, if needed, to prove his suspicions were just that...suspicions. He refused, obviously wanting to push this even further. When he asked what was in the rear of my wagon, I told him it was music equipment...but also mentioned that I was fairly certain that if HE wanted to search that equipment, HE was welcome to remove it and search it as needed, since I was NOT obligated to remove it for him. Needless to say, he declined to search any further.
No need to gang up on local law enforcement, as some are good at what they do and are greatly appreciated.
It's just that some of them suck out loud, and shouldn't be allowed to wear their badge or carry a gun. Unfortunately, as in your case, many of those fools go on with their misdeeds, completely uncontrolled and often ignored until something goes horribly wrong...then no one wants to accept responsibility.

about 2 years ago i was coming up highway 52 near king and was pulled over by a king police officer. it was about 2 am and i was driving a ford windstar minivan back from darlington sc for a car dealer. one front headlight was out and i knew this but i didnt care i just got paid to deliver the cars not fix them. anyway he stopped me because of the headlight and took my license back to his car to check my records. he came back up to the vehicle and said it was going to take a while and asked if i mind if he searches the vehicle. i told him i didnt care i had just picked it up and didnt know anything about it. he had a k-9 unit come out and check it. i was still in the vehicle, when the dog got near the pass rear quarter panel it went crazy barking. i thought oh crap you never know what is in these sale cars. then the first oficer came up to my window and asked me to step out of the vehicle so he could pat me down. when he did this he never touched my groin at all, just patted my legs up and down each side. after that he handed me my license back and told me he appreciated my cooperation and to have a nice night.
i always try to stay on the good side of the law. i have many friends that are mt airy pd. the only tickets i have ever gotten are a seatbelt ticket at 16, tinted windows, and a speeding ticket 3 years ago all in 16 years of driving. i get nervous being pulled over just because of things like this thread happening to you. but to this day i can not figure out why that dog went crazy and then they did not do anything? maybe they were testing me?

Im with you, I try to stay on the good side of the law as I have friends who are on various depts of NC Law Enforcement.
 
Not related and different area all together but here's my story:

Back in the early summer myself (wife), Friend1 (wife), Friend2 (wife) were all riding our motorcycles out towards Hanging Rock... First off.. All fairly new sportbikes... all in full gear, etc. Well on the way out towards King some showoff kept riding stand-up wheelies back and forth down the road... His girlfriend was following and video taping him in her eclipse. Well apparantely they pissed off some guy in a pickup and the pickup guy brake checked the guy on the motorcycle (during a standup) and alsmost caused him to wreck...

Long story somewhat short.. the guy on the bike was upset and kept flipping him off... brake checking continued... then all of a sudden the guy on the bike throws a u-turn off at about 35mph and takes off in the opposite direction.

We're about a 1/4 mile back and were like what's is going on here... So we just keep on minding our own business and head into King to grab a bite at Wendys before riding towards Hanging Rock.

Next thing we know it was something out of a cops episode... 3 crusiers pass us and I was thinking man they're going after the guy.... NOooooooo.. they whip it around and come back after us.. All at the same time here comes the whole King PD up the road..

So we pull into Wendys and get off the bikes.. Next thing we know we're completely surrounded with atleast 8 guns drawn down on us w/ the LEOs screaming where's the gun, whos got the gun, show me your hands... all that crap...

We calmly explain you obviously profiled us b/c we are on bikes and no one of has done anythign wrong.. no one's carrying a gun, etc. Basically our wives were scared to death... I was extremely pissed off... and the guy (pickup driver) kept claming that WE were the ones that were doing the wheelies.... HE even claimed he saw us flash a gun at him while doing a wheelie....(so now picture this... Riding a standup wheelie, wife on the back, obviously using my Left Hand to draw and flash a pistol, Right hand working the throttle... sounds believable right)

The guy couldnt even tell the cops what color bike was behind him.

We were harrassed, drawn down on in plain daylight in the Wendy's parking lot for minding our own business for all of atleast 20 mins... All the cops said as they were leaving and handing us our license back was... have a good day... No Sorry or anything like that...

I have very little respect for LEOs anymore and absolutey ZERO respect for King pigs.... sorry for the story...


Some may say they were doing the right thing... but there is absolutely NO reason to simicircle a group and draw down on them based on a verbal threat of a gun from a guy over the phone who cant even indentify the fact that bright green bike was behind him.

Oh yeah.. we didnt even get searched...
 
Good luck and please post what you can of further information. But also, please be careful what you post, as the LAST thing any of us want is somehow this to come back as a slander type thing against you.

Good luck, sorry to hear about all this. It is officer's like this, that make some of us bitter and not overly friendly to officer's that ARE doing their job properly.
I've had bad interactions, and pleasant ones. The first bad one, I was in college, got pulled over and searched. They proceeded to pull all the carpet out of my car, broke a speaker mount, tore the cabling for my amp, actually pulled open the cover on one of the back seats, generally DESTROYED my car. Everything was sitting out, it started raining, they said "have a nice day." When I asked about a hand putting stuff back in, they claimed that was not their responsibility, and got in their cars and all left but one. When I walked over and asked why was he staying the reply ticked me off more. "I'm making sure you don't leave any trash on our roads."
Well, like a typical college kid, I ran my mouth trying to make a scene. Instead of being calm, polite, and rational. (Like it sounds like you are, which is amazing.) Well it resulted in me basically avoiding that county until i got a different car.

Good luck, and hopefully something will come out of this, at the least that officer might realize he needs to act decently to people.

Edit: Just as to balance it, I've been pulled twice now by Morrisville PD, and both times the officer's were VERY friendly, I was polite, they were polite, etc. One time got a warning, the other time I got pulled, the officer was looking for a different black jeep.
 
I sent a email early monday January 5th to the Lieutenant
w/ the pic attached. However I called around a.m. on monday and found out via voice mail that Lieutenant Osborne left for a week long vacation. I called back and spoke w/ the opperator and asked to speak to the Sheriff, she asked me what it reguarded and told me to hold, bout 5min later she said he was on the phone and asked me to hold or if he could call me back. Having a prepaid phone I elected to have him call me back. Now I just wait I guess, till after lunch at least.

BTW I am careful what I write/say, slander is not the truth, this is the truth.

"Hello, Lieutenant Osborne, My name is Jonathan Waddell and I was pulled over on January 2nd and detained by Detective Darisse. As noted in my statement I was pulled over for no reason except that Detective Darisse wanted to search the vehicle and harass/ assault a law abiding citizen. The Bill of Rights, 4th and 5th amendment were violated by your aggressive officer. I was detained in the cold and did not consent to the search. The officer stated that the headlights were not burning but the conditions that are in the attached photo tell a different story. I was also given a false badge number when requested it from Darisse. I feel that the excessive touching and abuse of me was because Darisse was trying to justify the illegal traffic stop. I am formally requesting the dash board cams and audio from both officers and Darisse's photos of my gun and ammo (the pictures of the clip should settle the issue with the missing ammo). You told me that you were pulling this info for me within an hour of the incident for me so I would like to know when I can arrange a time to pick it up. I would like to arrange a time to meet with Sheriff Graham Atkinson.

Just some things that might help me out...

-What is the exact headlight laws?

-Whats up with vehicle frisks w/ my situation? (being calm and identifing myself as not a threat off the bat)

-Whats up with the fact that I did not have my consealed permit- Gun on dash loaded/chambered?

-Why would you search a suspect twice? (Not my fault he failed to do what ever he thought he failed to do before returning me to the truck, he sould have done the vehicle frisk then not the last thing before he let me go)

-Anything in perticular that I can say tomarrow to make this not be swept under the rug in Internal Affairs?

As noted in my statement I was pulled over for no reason except that Detective Darisse wanted to search the vehicle and harass/ assault a law abiding citizen.

You are going to have a hard time persuading a judge of that.


My suggestion is to stick with the facts- it sounds like you may have a case, but your statement above won't be taken seriously by anyone in law enforcement.

Also, what is your end goal? A public apology, a suspension of the officer? Make sure every move you make right now has your end goal in mind.

If you are hoping to get anything more than a "we'll look into this" reply from the police department, you are going to need a lawyer.
 
Internal Affairs Officer Livengood finally contacted me to tell me that the Lieutenant Osborne is out of the office for 2 weeks. He said that we have to wait till he is back. I stated my concern with them having a Rouge cop on the road and I explained my situation. He said that they are doing an internal investigation but there would be no way that I could find out the results because it is for internal perposes. I asked him the other officers name, he said he did not know but will find out. He also said they have the audio and video but can't review it for 2 weeks. He then told me to have my lawyer contact their lawyer and I stated that I am my lawyer and I represent myself and I request access to the dash cams and audio as well as the photos my gun and ammo. I asked if Darisse is on patrol and they said that he did nothing wrong so there was no reason to assign him to a desk. The he told me that he really doesn't know what happened and asked for my statement again so I pasted the origional story i gave you guys and added some requests I posted it below........

THE FACTS:

-Darisse had no reason to pull me over (no rain and after sunrise)
-After the "Terry Frisk" there was no reason to perform a second pat down
-I identified myself as not a threat (hands at 10 and 2 and pistol on dash)
-Missing ammo when gun returned after the illegal search
-When asked to search I replied "No" He responded with "well I'm doing it anyway"
-Darisse was very rude and physical
-Called 911 immediately after the illegal search and fondling
-Surry County violated my 4th and 5th amendment rights
-No immediate action was taken to prevent other innocent motorist from being molested and searched during this investigation of Darisse
-Darisse acted as a "rouge cop" taking the law into his own hands
-Illegal Search of vehicle

REQUESTS:

-I am formally requesting that this be put in Detective Darisse's personnel folder.
-Formally requesting the dash board cams and audio from both officers and Darisse's photos of my gun and ammo (the pictures of the clip should settle the issue with the missing ammo).
-I also formally request that Darisse be taken off the streets and assigned to a desk pending the results of the internal affair investigation.

THE INCIDENT:

On January 2nd 2009 I was returning to Mooresville NC from Bluefield WV in my brother's 2003 Toyota Tundra. I left Bluefield around 6:15 a.m. and traveled down I-77. I hit some snow till I reached Wythfield VA. It was a little overcast but daylight hit around 7ish as I traveled thru Galax. About 5 miles I tuned my headlight off and left my running lights on after seeing other vehicles in both directions do the same. As I came into Surry County NC around 7:45 am I noticed a Surry County Sherriff in the median. I glanced at my GPS and noted that I was going 72mph in a 70mph zone with my cruise control on. The detective Matt Darisse of the Surry County Sheriff pulled out of the median and decided to pull me over. I have a concealed carry permit but had my loaded gun (walther PPK/S) on the dash. I reached for my wallet but only found my driver’s license. I pulled over near the weigh station out my hands at 10 and 2 while holding my license. Detective Matt Darisse approached from the passenger side where I said first off before he said a word "I have a concealed carry permit but cannot find my permit and my gun is on the dash". Then I said "why did you pull me over" Detective Matt Darisse said "I failed to burn my headlights." I responded with "it is after sunrise with no rain or snow" My dog barked at the officer and I told him "she is friendly but loud and won't jump out." He then asked me to exit the vehicle and step to the back. I looked up the south bound lane and Darisse said "what are you looking for?" I said "all the other vehicles that don't have their headlights on" He then had me spread my legs past shoulder width while he frisked me for "his safety" which I certainly agreed with. He patted me down from my neck to my feet. he went up my legs to my groin then down the other leg stopping to feel my groin and then down the other leg and back up finishing at my groin for a 3rd time. I felt very uncomfortable with Matt Darisse's hands feeling me up with a cupped hand. He asked me to explain why I was traveling on the road that early which I responded with "last night my girlfriend and her 6 year old daughter totaled her Cadillac catera 10 miles from exit 82 on I77 north when they hit a 140lbs+ 8 point buck at 7:30 pm". Then I told him that I had to drive to pick them up at a truck stop at exit 82 where a state trooper dropped them off. (I actually took pictures and met the tow truck driver and transferred all of their Christmas presents into my bros truck in the event it was totaled) I then told the detective that I drove them home to Bluefield woke up at 6 and drove home cause I had to work at 12:15. He said my story didn't make sense and he asked me to return to my truck and disarmed me saying he was could write me a ticket for the pistol. I stated I did nothing wrong. He returned to his vehicle when another unidentified officer pulled up behind detective Darisse. They spent some time talking and running my numbers and stuff. A couple of minutes pass and both officers ask me to exit the vehicle again, I said this ridiculous, I did nothing wrong, that's when Darisse grabbed my right arm and forced me to side of his cruiser where I meet officer #2. I felt like he was trying to get me out of the dash board cam view. I spoke to the other officer about the other cars and trucks on the road without their lights on and he responded with "when we are on a call and we see someone else breaking the law we need to finish the first before we can move on to the others". I also stated again that is was after sunrise with no precipitation. The 2nd officer asked to pat me down again for the second time and pushed me over the side of the hood. This is where it became degrading. He searched my groin area with a cupped hand 2 times and referred to my groin as my bulge kept asking if I am hiding anything in my bulge where he touched me inappropriately a 3rd time. He continued talking about my bulge that's when "I asked to be taken down to the police station" because I felt it was out of hand. I felt violated and somewhat sexually assaulted by my groin being groped 6 times and me searched 2 times. Darisse unchambered my gun which holds 7 in the clip and 1 in the chamber. Lecturing me on why I feel the need to carry a gun. I responded with "uhhh because it's my right to "I then said I am surprised you are unloading it cause that's a first for me" He responded with "you get pulled over a lot?" I responded with "only at license checks" Derisse photographed my pistol and when I thought they were going to release me Darisse asked if he could search the truck I said "no!" he said "why" which I responded with "I know my rights and it is a waste of my time and yours" He said "well I going to do it anyways" As he approached the truck I said "I have a dog" "you said your dog was friendly" "she is but she might jump out" "well you said she won't jump out" That was before you were going to open the......" I bit my tongue as he was walking towards me. Well he searched it anyway while the other cop tried to be buddy buddy with me. But I told him and detective Darisse to use the k9 unit from Darisse's cruiser but he refused to have his dog search. Darisse then moved to the driver’s side where he returned pumping his fists saying "We got a concealed weapon here!" As he returned with the alleged concealed weapon I notice that it was a 3 1/4" fixed blade Gerber knife. As Darisse photographed his bounty I turned to officer #2 and said that it is completely legal to have knifes under 6" concealed in NC he responded with a "I dunno" Darisse said I can leave as he handed me a warning ticket #2526 on form SCSO308 for "other--not burning headlights" I asked about my gun and knife and he said it was in the truck. I then asked Darisse for his badge number, where he responded with "it's either 103 or 113" so I asked for his card he said no so I asked for his license plate #. Which he responded with you need to get out of here. As I left I noticed that I now only had 7 .380 rounds instead of 8. I drove a little farther till the next exit where it started to snow and I was upset about what just happened and how violated that I felt. I started thinking what if that were my girlfriend and her daughter getting groped like that. The cell was dead so I went to the nearest pay phone and called 911. I told the operator that I was sexually assaulted and illegal searched for no reason at all. I told her the whole story and she sent out a Lieutenant to take my complaint. I told him the whole story and wrote a 2 page statement. One of many things he thought was odd was the fact that Detective Darisse refused to search the truck with his dog. The Lieutenant was concerned about my ordeal and said he is pulling the dashboard cams and uniform audio and he will call me and send me an official report of this incident.

Sounds familiar. I was more than ready for the officer to complete whatever search he felt necessary, but his intentions were to drag his search out. He was bored and looking for someone to pick on. It was 3:00 am. I was obviously in the wrong place at the wrong time.
I hope no one misunderstands what I've added so far. I have friends that are in law enforcement here in Forsyth County. Some officers are absolutely incredible and go above and beyond the call of duty. Some are derelicts with little more than a high school diploma and BLET certifications, yet somehow they manage to stay employed.
Hats off to those who do the job well. I got pulled for speeding in Brunswick County VA last May. I was speeding, and I earned the ticket fair & square. The officer was direct, civil, and honest when giving me the ticket. He even asked what I was doing in Virginia, and I had no problem answering any of his questions. The guy was a true professional.
 
Got another call today can't remember this guy's name, they want me to refer everything to the county lawyer. Imagine that, I am willing to give him a day and then if I cannot arrange a time to get the information I requested and meet the Sheriff, then I might send a letter to the SBI. After all they are investiagating an officer near charlotte today for rape.
Funny thing I found out that Captin Livengood is in charge of internal affairs but he couldn't even tell me the other officers name, said he didn't watch the videos but told me that Diresse did nothing wrong to justifying him to being assigned to a desk or on leave. So you would think that an accusation of sexual assult and disreguard of admendment 4th and 5th within minutes of the traffic stop would be top priority. Not just something to get to in a couple of weeks. What if this was your wife/daughter? Could not imagine a woman going threw that. Should it matter male or female on the priority list?
