Molested by Surry County Detectives

Where do you get his actions have been "looked into"? That document is a simple court report. As I read, it appears that the Officer knows his job and performs it well. Stop a vehicle for a traffic violation, uncooperative suspect, find weapons, and search the vehicle. Sounds familiar.


1. Search and Seizure_automobile_visual observation_not a search

A detective's visual observation of defendant's movements in an automobile was not a search for Fourth Amendment purposes. A person traveling in an automobile on public thoroughfares has no reasonable expectation of privacy in his movements from one place to another.

They stated that he got searched because of a movement that he made inside of the vehicle.

THAT IS A VIOLATION OF HIS CIVIL RIGHTS.....

Example:
I am coming to your house tonight, to look through your wifes underwear drawer and shit in your toilet. If you say no, I am gonna do it anyways.

When Detective Darisse stopped defendant, defendant stepped out of the car and approached Detective Darisse's vehicle.
Detective Darisse ordered defendant to return to his car, but defendant would not do so.
Thereafter, Detective Darisse secured defendant in the backseat of defendant's own vehicle,
While seated in the backseat, defendant told Detective Darisse that there was a gun in the car.

That is the reason he conducted the search.

First off the example is in no way, shape, or form similar to the text you posted.


How can you expect what you do in a glass box in public to be considered private. what you are saying, is that is a cop walked by the car, and sees an occupant doing something obviously shady that it is a violation of rights to take the serach any further? Oh yeah officer, I was hurriedly reaching under my seat as i saw you approaching, but i promise i want hiding anything... or reaching for one of the 3 guns... i promise!

But, since he is a law abiding citizen without a crimianl record, he gets harrassed and ILLEGALLY searched and nothing happens to the real criminal..... thats BS time 1,000,000

If you break the law, even if you dont know it, or for even for somthing as small as littering or not using a turn signal, you get in trouble.

He could have used his dog. He could even have said that the dog pickedup on somthing, and then and only then could he LEGALLY search the vehicle. Jon even told him to use the dog but the officer refused.

The officer committed a crime against Jon and now it seams that the police are trying to cover it up.
 
Cops are human. They make mistakes. Some are just @ssholes about it and ignorant to their mistakes so they are stubborn when called out (like alot of people). I have met good and bad cops. Mostly bad, they think they are above the law and better than anyone else in their custody (which the second part is mostly true). I dont have a criminal record. I was mistakenly taking to jail overnight b/c the York county cops found my friend knocked out behind a gas station. My friend and I came there to pick him up and found him that way. The cops asked me what I was doing there and I said to pick the guy up. They said, well we think you and your other friend here were involved in this viscious beating. I said are you kidding me. They placed me and my friend under arrest for 2nd degree lynching (which is a felony!!). I was livid, but kept my cool. So I had to bail myself out at $300. Then I did my own detective work and kept contacting them to clear my name for their mistake. Overall, the charge got dropped, they realized they made a mistake after I gave them all the proof. But it is still on my record as "dropped" so now I have to pay a lawyer to get it exponged!

Never received an apology from the police dept nor any respect and lost money from the whole ordeal. The cops at the station deal with stupid criminals all day so I didnt expect and respect there.

As for who would you call when your stereo is stolen? Not the police. They dont care. They dont even want to take the report but have to. They wont take prints and they wont follow up.

And DurnZuki - I would love to see a cop give me a ticket for 1 mile an hour over and me get convicted for it! Maybe for someone who doesnt know the law and represents themself in court then yea I could see that happen. But I dont beleive it... Might need some proof on that to sway me.

I am joining into this topic real late and by no means hate police, but that being said there are a lot of them who abuse their powers. When an officer abuses his powers citizens have every right to stand up for their self.

BucketObolts appears to be a blue wall supporter and I would be willing to bet they are involved in law enforcement in some way. The claims this officer committed no crime is not actually true. If he sexually assaults someone during the course of the stop that is against the law. Just because the "Farva" look a like did this in the course of a questionable legal search does not make it any less of sexual assault. But again this officer is innocent until proven guilty, but the pics of him harassing does prove he is a dick.

If any one of us on this board fondles someone’s private parts with out their permission we will be arrested for sexual assault.
 
To me, with as much emotion as the OP and his brother have put into this, It really makes me wonder how much he is dramatizing the groping incident. I hope that if it really happened that way, the officer is rightfully punished. But I would say there is quite a bit of leeway in what might make some people feel violated and what one officer might feel the need to do to protect himself from any possible hidden weapons(with that area of the body being a popular area to conceal something)

I also agree that whether the first stop was legal or not, that cop really showed his ass with the whole gas station incident, and that does lead me to believe that the poster is telling the truth, because it is pretty obvious that this isn't "one of the good cops"

Quite honestly if this was my thread I might ask to get it locked or deleted, because if hyperlite begins a legal case, stuff like this never looks good if found.

Just my opinions on the matter
 
i agree he pushed his power's to far..In my run ins with the law I seen some abuse the power's so bad that i was on the edge of hiting them and then i seen some go out of there way to help me even when i was in the wrong. i have been arrested 14 times spent total of 8 years locked up. not once has a cop felt me up i think he was way out of line on that everything else i see he was trying to hard to be a good cop.

Umm, unless you know the officer, don't ask them to shake hands unless you want to be politely declined. Easy way to pull him into you and take his sidearm, and they know that. There's a reason they prefer to stay at arm's length.

This thread is getting pretty silly though, and for the OP to quote Obamarama, of all fucking people, to quote about freedom is irony of the highest caliber.
 
About the search. I *think* it is SOP to search "sensetive" areas with the back side of your hand as to not be procevied as sexual harrasment
 
What Matt, customcruiser is trying to say is in reguards to the fact that they (Osborne) were trying to justify the pull over and search, because it is a "personel matter" they can not tell me why I was pulled over and searched. The reason I was pulled was for not burning my headlights which is on tape and on the warning ticket. Mr. Woltz (their lawyer) says that the conditions are good enough for not running my lights (nc law states in fog/overcast you must have them on if you can not see 500 ft in front of you). Osborne says to me during our meeting that you must have been doing something in the car before the pull over to justify the search. This is not probible cause.

I want the tapes on the net asap. I want you guys to know what is going on in our state, you will be able to see them hopefully by the end of the weekend.

Here is what I was told is the end of the tape. This is the actual tapes taken from both cars personally by Osborne after the report was made. Remember this is the end of the film, when it is no longer able to tape anymore (last 2 pics)

I cant beleive they gave you the tapes to use against them! Shocking! I bet they are edited/cropped. But I hope not. I like to see citizens receive justice on overzealous cops!
 
Osborne said he personally removed both tapes about 1 hour after he took the report from Jon. He says he has the only key and nobody else can swap out the tapes.

Look at the time on Darrise's tape 8:37; the 911 log and dispatch log say:
8:14:18-8:18:08 Jon Called 911
Osborne dispatched at 8:24:14
Osborne Completed 9:31.56
Look at the hand writing, they are 100% different.
Look at the label on the Derrise (103) it looks like it just got put on.

Ahhhuuumm....You do not need a search warrant(spelled correctly) to search a private vehicle on a public highway. Did you not read the link you posted. Probable cause is all the officer needs. Nothing illegal was committed.

I am by no means affiliated with any law enforcement in any way. But you will have to prove beyond a reasonable doubt any of the accusations you are making.

Before you play a game, you should probably try to figure the rules out first. BTW, they already know the rules. Its going to be very difficult to beat them at there own game.

Detention of the vehicle beyond this brief time needed to issue a citation or warning requires reasonable suspicion of illegal activity. "Once the driver has produced a valid license and proof that he is entitled to operate the car, he must be allowed to proceed on his way, without being subject to delay by police for further questioning." United States v. Walker. "Any further detention for questioning [not for issuing a citation] is beyond the scope of the Terry stop and therefore is illegal unless the officer has a reasonable suspicion of unlawful activity." United States v. Dewitt.

The officer states on the video that he has a concealed carry permit.

The only probable cause would have been drugs.

From what ive been reading even smelling pot from inside the car isnt PC.

The officer was a k9 unit, if he had just taken the dog out of the car like requested by Jon we wouldnt even be discussing this.

Im already tired of it.........
 
Not really any updates, I have not called them or been contacted in a while. They (Darisse and Ward) probably won't every have anything happen to them. It just a crazy idea to me that there is no check and balance for our police force's questionable actions. They can make their own rules and break our laws and when it gets controversial they can alter evidence, lie and cover it up by saying it is a "personnel matter". Oh well that's life..... I still have options that I can take just want some time to think of them.
I want to get the videos on u-tube but they are too big if I record them using my digital camera. I am going to try to record it with my buddys new digital video camera that takes video directly on flash cards.
I am still open to advise on my next step in the matter, if you guys have any advice, let me know.
