It doesn't come to who is at fault it comes to how much it cost to defend yourself or it is cheaper to settle it for less money. Most lawsuit around here anyway works that way in a auto accident.

It doesn't say directly but heavily implies that the driver was responsible for the crash that caused the injuries. If that isn't the case, then, well, there is no case

The more concerning thing is this notion that the TOS when ordering food from UberEats waives your rights to a trial for something completely unrelated that happens in the future.
